ABD Maestro Private Limited (“ABM”) provides all information on this website, exclusively under the following Website Terms and Conditions and all the applicable laws.

By accessing this website (“the Site”), you are agreeing and accepting that these Website Terms and Conditions and Privacy Policy (“Terms and Conditions”). Any use by you of the Site is governed by the Terms and Conditions. Please exit the Site immediately if you do not accept the Terms and Conditions or are not of a legal age for consuming alcoholic beverages in the country or other territory in which you are located or are in a country or other territory where use of this Site is not permitted.

By using the Site, you represent and warrant to ABDM that you are legally allowed to drink alcohol in your respect state and/or country, or other territory.

All references to ‘our’, ‘us’, ‘we’, or ‘Company’ within these Terms and Conditions are deemed to refer to ABDM.

1. Rights and Restrictions on use

The Site, including the domain name of the Site,  the marks as well as all the content and all other elements (including but not limited to: architecture, tree, logos, visuals, texts, comments, illustrations, images animated or not, files, sequences, video, sounds, etc.) reproduced on the Site are protected under applicable laws relating to intellectual property and/or databases. They are owned or licensed to ABDM or its partners. Unless as expressly permitted by law, or ABDM, or by the applicable licensor, in writing, you are not entitled to reproduce, transmit, license, sell, publicly perform, distribute, adapt, translate, modify, bundle, merge, share, or otherwise make available to any person, or to create derivative works of, any or all of the materials and/or content available on the Site, or to use it for any purposes. The permission shall be to the extent permitted by these Terms and Conditions.

2. Intellectual Property

ABDM is the owner/authorized user of Site, including the domain name of the Site, all trademarks, service marks, design marks, trade dress, patents, copyrights, database rights and other intellectual property (collectively, the “Intellectual Property”) appearing on or contained within the Site. No license to use any of the Intellectual Property is granted to you by including them on the Site. Any reproduction, representation, adaptation or translation, in any form whatsoever, in whole or in part of the site or elements of the site without the prior written approval of ABDM is strictly forbidden and involves the responsibility of its author.

3. Use of Public Forums and User Conduct – Terms of Use

The Site may include interactive features such as discussion forums, blogs, bulletin boards, chat rooms, and social media integrations, including content displayed from third-party platforms (“Interfacing Sites”) as outlined in Section 4 (collectively referred to as “Public Forums”). These features may allow you to submit content such as text, images, audio, video, or other materials (“Postings”).

Please note that we do not actively monitor or moderate content posted in Public Forums and may or may not exercise editorial control. By using these features, you acknowledge and accept that you may be exposed to content that is inaccurate, misleading, or offensive. Your use of Public Forums is entirely at your own risk.

We reserve the right, but are not obligated, to monitor, edit, or remove any Postings that, in our sole discretion, violate these terms or are otherwise deemed inappropriate. We may restrict, suspend, or terminate your access to the Site and related services if we believe there has been any misuse.

Prohibited Uses of the Site include (but are not limited to):

• Using the Site for any unlawful, unauthorized, or immoral purpose.
• Posting or transmitting content that is defamatory, obscene, abusive, offensive, or discriminatory based on race, religion, gender, or any other protected category.
• Promoting or encouraging excessive or irresponsible consumption of alcohol, including underage drinking or drunk driving.
• Sharing or transmitting content that violates the intellectual property, privacy, or proprietary rights of any third party.
• Engaging in activities that interfere with or disrupt the functioning of the Site, including hacking, flooding, or introducing harmful code.
• Impersonating any person or entity or providing false or misleading information.
• Sending unsolicited advertising, promotional content, or spam.
• Sharing any personal information (your own or others’) such as phone numbers, addresses, or email addresses in public areas of the Site.
• Attempting to access or compromise the security of the Site, its systems, or user accounts.
• Violating the terms of use of any linked or interfacing website.
• Engaging in any conduct that contravenes applicable laws or public policy in your jurisdiction.

This list is illustrative and not exhaustive. We reserve the right to take appropriate action in response to any behavior that we believe breaches these terms or undermines the safe and responsible use of the Site.

User Submissions and Responsibility: By submitting any content to the Site, including to Public Forums, you confirm that the content is original to you and does not infringe on the rights of any third party. You also waive any moral rights in such content and grant the Site operator a worldwide, royalty-free, perpetual, non-exclusive, transferable, and sublicensable license to use, reproduce, publish, adapt, distribute, and display such content in any media now known or developed in the future.

We are not responsible for the use or misuse of any data, including personal information, that you choose to post publicly. We reserve the right, but are under no obligation, to remove content that includes personal data.

We are not responsible for maintaining or storing your Postings and may delete them at any time without notice.

Disclaimer and Release: Content posted by users on Public Forums does not represent the views of the Site or its affiliates. We make no representations regarding the accuracy or reliability of such content. You agree to independently evaluate all information posted by users and release us from all claims arising from disputes with other users.

 

4. Third-Party Websites and Liked Content

You acknowledge and agree that we are not responsible for the content (“Linked Content”) hosted on third-party websites (“Interfacing Sites”) that may be linked to or displayed on our Site through application programme interface or other technologies.

We do not host, or control Linked Content. The presence of such links or content does not imply any endorsement, affiliation, or approval by us of the Interfacing Sites, their content, products, services, advertisements, or any other materials. You agree that we are not liable for any loss, damage, or cost—direct or indirect, arising from your use of or reliance on any Linked Content or services offered by these Interfacing Sites.

We reserve the right, at our sole discretion, to remove any Linked Content from our Site or restrict access to Interfacing Sites, where possible, at any time and for any reason, including violations of these Terms and Conditions or the terms of use of the respective Interfacing Site.

Certain features of our Site may require you to create accounts with Interfacing Sites, including setting up usernames and passwords. As these sites are not affiliated with us, we are not responsible for any data they collect, including login credentials. We will never ask you to share your password for any Interfacing Site. 5. Disclaimers of Warranties and Assumption of Risk

6. User submitted materials

Unless specifically requested by us, we do not solicit nor do we wish to receive any confidential, sensitive, or proprietary information or other material from you via the Site or any of its services, by email or in any communication channel. Any information or material voluntarily submitted by you, without our express request will be considered as non-confidential, and non-proprietary.

7. User’s responsibility

We may offer you to create an account with a username and password to access and use certain areas of the Site including Public Forums, and other services.  You may only create an account if you are of legal age to purchase alcohol in your country of residence and in the country in which you are accessing the Site.  You agree provide us with accurate account information.  You are solely responsible for maintaining the strict confidentiality of your account password, and you are responsible for any activity using your account and password. You agree to (a) immediately notify us of any unauthorised use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session.

You are fully responsible for managing access, and use your account and password and to notify us when you wish to cancel your account. We will not be responsible or liable for any loss or damage arising from your failure to comply with this provision.

9. User Information

In the course of your use of the Site, you may be asked to provide personally identifiable information to us (such information referred to hereinafter as “User Information”). Our information collection and use policies with respect to such User Information are set forth in the Privacy Policy. You acknowledge and agree that you are solely responsible for the accuracy and content of the User Information.

10. Indemnity

You agree to indemnify and hold harmless us, along with our officers, directors, employees, agents, representatives, affiliates, and partners, from and against any and all losses, damages, liabilities, claims, costs, and expenses (including legal fees) arising out of or related to:

You waive and release all claims against us and agree to hold us harmless from any liability arising from injuries, damages, or losses connected to any events or activities facilitated through or related to the Site. This includes, but is not limited to, risks associated with internet-based threats such as hacking, data breaches, or technical failures. In the event of any such incident, we shall not be liable for any loss of user data or unauthorized access by third parties.

We reserve the exclusive right to assume the defence and control of any matter subject to indemnification by you, and you agree to cooperate fully with us in such defence.

11. Limitation Of Liability

To the fullest extent permitted by applicable law, the Company—including its sponsors, advertisers, affiliates, parent company, officers, directors, employees, agents, representatives, contractors, sub-contractors, successors, and assigns—shall not be liable to you or any other party for:

1. Indirect, incidental, special, punitive, or consequential damages, or any other losses arising from the availability, use, reliance on, or inability to use the Site, even if the Company or its representatives have been advised of the possibility of such damages, regardless of the legal basis (contract, tort, or otherwise);
2. Any claims resulting from errors, omissions, inaccuracies, or harmful elements within the Site or its content;
3. Any failure to perform obligations due to causes beyond our control, including but not limited to mechanical, electronic, or communication failures or degradation;
4. Any misuse, illegal activity, or third-party content posted by users. You acknowledge that most content is user-generated, and the Company does not control, create, or publish such postings or listings;
5. Risks associated with participation in public or private events or use of services accessed through the Site. You understand and accept that such activities may involve unforeseen hazards, and you are solely responsible for any associated costs or risks.

You agree to waive and discharge all claims, and to release and indemnify the Company, its affiliates, officers, agents, employees, and partners from any and all liability arising from injuries, damages, or losses connected with your use of the Site or participation in any related events or activities. This release is binding upon you and your heirs, executors, administrators, agents, and assigns, and includes any minors accompanying you.

In the event of internet-based threats such as hacking, data breaches, or technical failures, the Company shall not be liable for any loss of data or unauthorized access by third parties.

12. Restriction, Suspension And Termination

ABDM reserves the right to terminate this contract at any point of time without providing any notice to the user. On such termination, the user shall not have a right to access the Site. We may restrict, suspend, or terminate your access to the Site and/or your ability to avail of any of the services on the Site, including interactive services, at any time if we believe that you have breached these Terms and Conditions. Any such restriction, suspension, or termination will be without prejudice to any rights that we may have against you in respect of your breach of these Terms and Conditions. We may also remove the Site as a whole or any sections or features of the Site at any time. Please note that we have the ability to trace your IP address and if necessary contact your internet service provider in the event of a suspected breach of these Terms and Conditions.

13. Governing Laws and Jurisdiction

This Site originates from Mumbai, Maharashtra, India. These Terms and Conditions, including the Privacy Policy, Cookie Notice, and any matters relating to the use of the Site, shall be governed by and construed in accordance with the laws of Republic of India, without regard to its conflict of law principles.

You agree that any dispute, claim, or legal proceeding arising out of or in connection with these Terms and Conditions, your use of the Site, or any related services shall be subject to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra. By using this Site, you irrevocably consent to the jurisdiction and venue of such courts and waive any objection to such venue, including claims of inconvenient forum.

14. Compliance with Local Laws

You are responsible for ensuring that your use of the Site complies with all applicable laws and regulations in your jurisdiction, including those related to the sale, promotion, and consumption of alcoholic beverages.

15. Entire Agreement; Severability

These Terms and Conditions incorporate by reference any notices contained on this Site and constitute the entire agreement with respect to your access to and use of this Site. If any provision of these Terms and Conditions is unlawful, void or unenforceable, then that provision shall be deemed severable from the remaining provisions and shall not affect their validity and enforceability.

16. Prohibited Conduct – Site Security

You agree not to engage in any activity that compromises the security or integrity of the Site. This includes, but is not limited to:

• Attempting to gain unauthorized access to any part of the Site, user accounts, or systems connected to the Site;
• Interfering with or disrupting the operation of the Site, servers, or networks;
• Introducing viruses, malware, or any other harmful code;
• Using automated tools such as bots, scrapers, or spiders to access or interact with the Site without prior written consent;
• Attempting to test, scan, or breach the security or authentication measures of the Site;
